A Permanent Pathway to Reunite Families in Australia
The Child Visa Subclass 101 is a permanent residency visa designed for dependent, adopted, or orphaned children of Australian citizens, permanent residents, or eligible New Zealand citizens. This visa must be applied for from outside Australia, and it allows children to live permanently with their parents in Australia.
Age Criteria:
The child must be under 18 years old, or
Between 18 and 25 years old, if:
A full-time student, and
Financially dependent on the sponsoring parent, or
Unable to work due to a disability causing total or partial loss of mental or bodily functions.
Relationship Status:
The child must be single — not married, engaged, or in a de facto relationship.
Child’s Relationship to the Sponsor:
Can be a biological child, legally adopted child, or stepchild (from a former partner only).
If the stepparent is the current partner of the child’s biological/adopted parent, dependency cannot be claimed.
Adoption Rules:
Adoption must have occurred before the child turned 18 and by non-Australian citizen or permanent resident parents.
If adopted by Australian parents, the Adoption Visa Subclass 102 may be more appropriate.
Sponsorship:
A parent who is an Australian citizen, permanent resident, or eligible New Zealand citizen must act as the official sponsor.
Sponsorship must be approved by the Department of Home Affairs.
Consent:
Legal consent from any non-migrating parent or legal guardian may be required.
Health and Character:
Standard health and character assessments must be met.
The child must not be affected by sponsorship limitations or in breach of Australian visa rules.
Permanent Residency: The child gains permanent residency, with access to Medicare, education, and other public services.
Pathway to Citizenship: Eligible to apply for Australian citizenship once residency requirements are met.
