A Permanent Pathway to Reunite Families in Australia

The Child Visa Subclass 101 is a permanent residency visa designed for dependent, adopted, or orphaned children of Australian citizens, permanent residents, or eligible New Zealand citizens.   • If the stepparent is the current partner of the child’s biological/adopted parent, dependency cannot be claimed.

• Adoption Rules:

  • Adoption must have occurred before the child turned 18 and by non-Australian citizen or permanent resident parents.

  • If adopted by Australian parents, the Adoption Visa Subclass 102 may be more appropriate.

• Sponsorship:

  • A parent who is an Australian citizen, permanent resident, or eligible New Zealand citizen must act as the official sponsor.

  • Sponsorship must be approved by the Department of Home Affairs.

• Consent:

  • Legal consent from any non-migrating parent or legal guardian may be required.

• Health and Character:

  • Standard health and character assessments must be met.

  • The child must not be affected by sponsorship limitations or in breach of Australian visa rules.

• Permanent Residency: The child gains permanent residency, with access to Medicare, education, and other public services.

• Pathway to Citizenship: Eligible to apply for Australian citizenship once residency requirements are met.
